Apostilization and Legalization of Documents in Kazakhstan
Apostille is a special stamp attached to official documents to certify the genuineness of a signature of an authorized person having signed such documents and the seal appearing thereon. The Apostille stamp is attached on original documents, notarized copies and notarized translations.
In accordance with the Convention Abolishing the Requirement of Legalization for Foreign Public Documents (concluded in Hague on 5th October 1961) the Apostille will be attached to the official documents of the Convention member states with the purpose to dispense with the necessity of diplomatic or consular certification/ legalization of such documents.
The ninety nine states having currently acceded to the Hague Convention undertake to receive documents with the Apostille attached thereon, which are issued at the territory of other member countries, not requiring any additional authentication thereof.
In other cases for authentication of a document, the latter shall undergo a consular legalization. The Apostille shall only be attached on the documents which are issued by state authorities (agencies), public officials or notaries public of the Republic of Kazakhstan.
In Kazakhstan it is not necessary to attach the Apostille to the documents:
- Issued by the Embassies or Consular Offices of the Republic of Kazakhstan abroad;
- Directly related to commercial or customs operations.
In order to endorse documents with the Apostille in Kazakhstan it will be required to present:
- The documents requiring apostilization;
- The document which certifies the identity of a citizen;
- Power of Attorney, if documents are presented for apostilization by an attorney or authorized representative;
- The receipt confirming the payment of the State Duty.
